Apparel Assurance Agreement

This Apparel Assurance Agreement (“AAA”) sets forth the terms and conditions applicable to, and describes the sole and exclusive liability of Rent My Wardrobe (“RMW”) with respect to, lost, stolen or damaged items. RMW may update this AAA at any time by posting updated terms on its website at http://www.rentmywardrobe.com, provided that the terms in effect at the time of a rental will apply to the applicable rental items.

What Apparel Assurance covers:

  • Normal wear and tear of the item, such as

    • Minor stains which are removed through professional dry cleaning

    • Rips at seams or in inconspicuous places where the appearance or function of the item has not been altered,

    • Missing decorative items which can be easily replaced,

    • Nominally stuck zippers or other minor damage which can be readily repaired and might be expected with the general use of the item for its intended purpose.

What Apparel Assurance Does Not Cover:

  • Lost items.

  • Theft of items.

  • Damage caused by gross negligence or willful misconduct.

  • Damage costing more than $500 to repair.

  • Any damage beyond normal wear and tear of the item.

THIS IS NOT AN INSURANCE POLICY AND IS NOT INTENDED TO REPLACE OR SUPPLEMENT ANY INSURANCE CARRIED BY RENTER OR LENDER. YOU ARE SOLELY RESPONSIBLE FOR OBTAINING SUFFICIENT INSURANCE TO REPLACE A LOST, DAMAGED OR STOLEN ITEM.

Replacement Cost Valuation of Rental Item: Lender is responsible for posting the full manufacturer’s suggested retail price (“FMSRP”) of rental item on RMW. FMSRP, for the purposes of these provisions, should be the full retail cost of the item at the original retail location it was purchased before any sales or other discounts were applied. The Lender is also responsible for posting a replacement rate associated with each listing. The replacement rate, not to exceed the FMSRP, represents the monetary value the Lender is willing to accept should the item be lost, stolen, or damaged beyond repair. The replacement rate is assessed at the sole discretion of the Lender and agreed to by the Renter before checkout.

$500 Limitation: RMW hereinafter limits its financial responsibility of this provision to a FMSRP of $500 per item. If the FMSRP is listed by the Lister at over $500, RMW will require the Renter to purchase additional apparel assurance in increments of $5 per $500 of additional coverage. Apparel Assurance can be purchased for items with a declared replacement cost values of up to $2,500. Written pre-approval by RMW is required for assurance for any items with a declared replacement cost value in excess of $2,500. There will be no assurance coverage afforded for such items without RMW’s prior written approval. You may contact RMW at [email protected] to request such approval.

Pre-rental Condition Inspection: At the time of the initial item delivery to Renter, both Lender and Renter agree inspect the item and to notate any damage, imperfections or alterations directly on the checkout screen within the mobile app. Inspection should include: Actual Garment, Size, General Condition, Discoloration, Staining, Rips, Tears or Runs, Damage to Beading or Other Ornamental Additions, Zippers etc. It shall be the responsibility of the Lender to ensure all fields are fully completed, and the responsibility of the Renter to notate any imperfections in mobile app at time of checkout.

Renter Use and Care Responsibilities: As the Renter, you agree to treat the items with great care. The Apparel Assurance covers normal wear and tear of the item. Normal wear and tear encompasses minor stains (which are removed through professional dry cleaning), rips (at seams or in inconspicuous places where the appearance or function of the item has not been altered), missing decorative items (which can be easily replaced), nominally stuck zippers or other minor damage which can be readily repaired and might be expected with the general use of the item for its intended purpose. The apparel assurance does not cover theft, loss, or gross negligence and excludes losses related to sentimental value, earthquake, flood, windstorm, acts of war or terrorism, loss of use or market, or repairs exceeding $500 (collectively, “Excluded Act”). Should any Excluded Act occur, the Renter will be charged, and agrees to pay in full, the replacement rate for the item.

Post-rental Condition Inspection: At the time the item is returned, Lender and Renter agree to complete a post-rental condition inspection. The Inspection should include: Actual Garment, Size, General Condition, Discoloration, Staining, Rips, Tears or Runs, Damage to Beading or Other Ornamental Additions, Zippers etc. It shall be the responsibility of the Renter to ensure front and rear photos of the item are taken in real time and the item check in is completed through the mobile app at time of return. It shall be the responsibility of the Lender to inspect the item and immediately report any damage or imperfections not previously notated in the rental agreement within 24 hours of return.

f there are any noted or disputed damages at the time of return each party is instructed to avoid additional discussions of such dispute, provide their documentation of their concerns including photographs of damage and submit their overviews to RMW for evaluation. RMW shall, at its sole discretion, determine whether damage in excess of normal wear and tear occurred and all decisions are final. By subscribing to or using the RMW platform you are agreeing to the terms of this AAA.

You grant RMW full discretion to investigate any and all claims, by any means determined necessary, to prevent fraudulent activity from occurring. Should it be determined that willful fraud or conspiracy is committed, RMW reserves the right to pursue damages and or criminal action to the fullest extent of the law.
